Aged Lead Purchase Agreement
Version 2026-10-17f · Seller: ProspectPro LLC
This agreement covers buying aged insurance leads through the Aged Leads card on prospectpro.cc/marketplace. It is between you (the buyer) and ProspectPro LLC (the seller of record).
1. What you are buying
Aged insurance leads are contact records for consumers who expressed interest in an insurance product (Life Insurance, Final Expense, or Mortgage Protection) at some point in the past. They are not live transfers, appointments or exclusive real-time leads. The age you pick is the time since the lead was first generated, in the bracket shown at checkout (for example, 30-60 days). We describe lead types and ages as accurately as our suppliers' records allow.
ProspectPro LLC sells these leads as the seller of record. We obtain them from third-party lead suppliers and resell them to you. You pay ProspectPro LLC, and ProspectPro LLC is responsible to you for delivery under this agreement.
Price is per lead, as shown on the order card, with no volume discounts. The minimum order is $350. Payment is one-time; nothing renews.
2. Delivery and availability
We deliver your leads by email, as a CSV file or secure download link sent to the email you entered, within 72-78 hours after payment.
Availability: if there aren't enough leads available in the states and age range you selected, we will contact you to fill the difference with another state or age range. You choose the substitute; we never substitute leads without your agreement. Delivery of the substituted part may extend beyond the delivery window while we confirm the substitution with you. If you don't want a substitute, we will work with you to fill the difference.
3. Sold as-is. No guarantee of results
Aged leads are sold as-is. Because they are aged, many consumers will have already been contacted, bought coverage, moved, or changed numbers. We do not guarantee that you will reach anyone, that anyone will be interested, or that you will make any sale, policy or commission.
4. Where the leads come from (consent)
Our third-party suppliers represent to us that the leads were collected from consumers who submitted their information and agreed to be contacted about insurance, as recorded by the supplier at the time. We do not collect the consent ourselves, we cannot verify every record, and we do not represent that any consent covers you by name, covers autodialed or prerecorded calls or texts, or is still valid today. Where a supplier provides consent details (such as date, source website or TrustedForm/Jornaya certificate), we will pass them on to you on request where available.
5. Your compliance responsibilities
You alone are responsible for how you contact these consumers. Before you call, text or email anyone, you must make sure your contact is lawful, including under: the Telephone Consumer Protection Act (TCPA) and FCC rules (including the rules on autodialed, artificial or prerecorded voice calls and texts, and the one-to-one consent rule where it applies); the FTC Telemarketing Sales Rule; the National Do Not Call Registry and state do-not-call lists; your own internal do-not-call list; state telemarketing and "mini-TCPA" laws (for example Florida, Oklahoma, Maryland and others), including state calling-hour limits, call-frequency limits and registration or bonding requirements; and CAN-SPAM for email.
You must scrub the leads against the National DNC Registry and applicable state DNC lists before calling, honor every opt-out and stop request immediately, and keep the records the law requires.
You (and anyone who calls for you) must hold the insurance licenses and carrier appointments required in each state where you solicit or sell, and follow state insurance marketing rules and, for Medicare-related products, CMS marketing rules.
6. No resale and data use
The leads are for your own business's use (you and your agency's licensed agents). You may not resell, rent, share, publish or give the leads to anyone else. You must keep the data secure, use it only to offer the insurance product type you bought, and delete it when asked or when the law requires.
7. Refunds and replacements
Only two kinds of bad leads qualify for a replacement: (1) a lead whose phone number is disconnected (not in service), and (2) a duplicate lead, meaning the same lead delivered more than once in the same order. Report them to partnerships@prospectpro.cc within 7 days of delivery, listing the lead rows. We verify each claim before replacing anything: we test each reported number ourselves and confirm each reported duplicate against your order. Our determination is final. Each verified disconnected or duplicate lead is replaced with one new lead of the same type and age bracket. Replacement leads are the only remedy; we do not give cash refunds or credits for bad leads.
These do not qualify for a replacement: wrong person or wrong number, no answer, voicemail, not interested, already insured, didn't remember requesting information, numbers on a Do Not Call list (including numbers removed by your own DNC scrub), leads you also bought elsewhere or in a different order, claims made after 7 days, or a change of mind after delivery.
If we don't deliver within 72-78 hours and you haven't agreed to more time, you may cancel the undelivered part for a full refund of it to your card. Approved refunds are sent to the original card within 10 business days.
8. Electronic signature and ID verification
You agree to sign this agreement electronically. Under the federal E-SIGN Act and Arizona's Electronic Transactions Act, your typed full legal name and the signature you draw on the order page are your legal signature, with the same effect as signing on paper. You can ask us for a paper copy at no charge by emailing us, and you may withdraw consent to electronic records for future dealings by telling us in writing; that doesn't undo a signature already given.
When you sign, we record your typed name, mailing address, email and phone, the agreement version, the time, your IP address and your browser (user agent), and we create a signed PDF of this agreement. Your copy is emailed to you after payment.
Photo ID and selfie: we ask for the front of a government-issued photo ID and a selfie taken at signing (a photo of your face, from your phone camera or an upload) to confirm who is signing and to prevent fraud, identity theft and chargebacks. A person on our team may compare the selfie with the ID photo; we don't create a faceprint or other biometric template from either. Your ID and selfie are stored privately, only ProspectPro administrators can access them, they are never posted publicly or sold, and they are used only for identity verification, fraud and chargeback prevention, and as part of our signed-agreement record. Your emailed copy of the agreement leaves the ID out, and the selfie too. We keep the ID and selfie with the agreement record for as long as we need them for these purposes and our legal and dispute records, then delete them. To ask about or delete your ID and selfie record (where the law allows), email us.
9. Disputes and chargebacks
Please contact us at partnerships@prospectpro.cc or text 541-965-5870 before disputing a charge with your bank. We answer billing questions within 2 business days and will work with you in good faith.
If you file a chargeback for a purchase you received or used, we may respond to it with this agreement, your acceptance record (the version of this agreement, the time you accepted it, and your order details), delivery or login records, and our correspondence with you. We may suspend open orders and access while a dispute is open. A chargeback that is decided in our favor remains payable.
10. Limitation of liability
To the fullest extent the law allows: our total liability for any claim relating to this purchase is limited to the amount you paid us for that purchase in the 3 months before the claim; and we are not liable for lost profits, lost commissions, lost policies, or indirect, incidental, special, consequential or punitive damages, or for fines, penalties or damages arising from how you contact, call or text anyone.
You agree to defend, indemnify and hold ProspectPro LLC harmless from claims, fines and costs (including reasonable attorney fees) arising from your calls, texts, emails, sales practices, or breach of this agreement, including claims under the TCPA, the Telemarketing Sales Rule, and state telemarketing and insurance laws.
11. Governing law and general terms
This agreement is governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute arising out of or relating to this agreement or your purchase must be brought exclusively in the Superior Court of Arizona in and for Santa Cruz County (Santa Cruz County Superior Court), 2160 N Congress Dr, Ste 2200, Nogales, Arizona 85621. You and we consent to the exclusive jurisdiction and venue of that court and waive any objection to it.
This is a business-to-business agreement. You confirm you are buying for a business purpose, are at least 18, and can bind the business you name. You accept this agreement by signing it on the order page (see "Electronic signature and ID verification"), checking the box, and paying. For this purchase, this agreement controls over the general Terms of Service at prospectpro.cc/terms, including its statements about card payments and renewals. We may update this agreement for future purchases; the version you accepted applies to your purchase, and for subscriptions we will email you before a change takes effect at your next renewal.
